Summary Judgment Granted in a Residential Project Lawsuit Involving a Defective Design
We defended an architect in a lawsuit brought by the developer of a residential development in New York City. Plaintiff claimed over $13 million dollars in damages due to alleged defective design against our client, who was the only named defendant. We successfully obtained an order from the Court precluding Plaintiff from offering any evidence of damages at trial due to their refusal to comply with their discovery obligations and prior court orders.
Summary Judgment was granted and the case has been dismissed in its entirety.
