Panel 1

So, You Think a Teaming Agreement is Too Much Trouble?

Thursday, Nov 03, 2022 9:45 AM - 11:00 AM PDT

Teaming Agreements, the legal arrangement that covers the pre-award phase of project pursuits, are one of the most important, variable – and least understood – elements of the design-build process. Too many teams skip this important step or give it short shrift, jumping into the project pursuit phase without aligning on how their firms will work together, share risk, share stipends and costs and cope with project realities in a fair manner. A well-crafted Teaming Agreement can pave the way for a successful pursuit, efficient negotiation of the Subsequent Agreement and seamless project delivery.

In this session, members of DBIA’s National Design Professionals’ Advisory and Engagement Committee will share their perspectives and recommendations about why and how to achieve effective Teaming Agreements. Each draws on decades of successful design-build experience and lessons learned while bringing a distinct perspective characteristic of their different role in the team.

Speakers:

  • Sean Gellhaus, Associate Vice President and National Contracting Manager, HNTB Corporation

  • Lee Slade, Managing Principal/Chairman of the Board, Walter P Moore

  • Robert Barbera, SVP, Turner Construction Company

  • Rachel John, Esq., Senior Associate, Zetlin and De Chiara LLP

  • Hollice Stone, President, Stone Security Engineering, PC

Panel 2

Fair and Balanced – What Makes DBIA’s Family of Contract Documents Different?

Thursday, Nov 03, 2022 3:00 PM - 4:15 PM PDT

DBIA’s newly updated family of Design-Build Contract Documents offer design-builder teams fair and balanced tools to help assure successful projects. The family of form contracts were developed by experienced design-build professionals representing the entire design-build team from the Owner to contractors, architects, engineers, and subcontractors. This session will examine how DBIA’s updated contracts compared with other generally available design and construction form contracts, such as AIA and ConsensusDocs. Further, the session will cover what key contract provisions were updated in the newly available 2022 editions of DBIA’s contracts and what new form contracts DBIA is working on.

Speakers:

  • Robynne Thaxton, Attorney, Thaxton Parkinson PLLC

  • Holly A. Streeter-Schaefer, Attorney, Burns and McDonnell Engineering Company, Inc.

  • Rachel John, Esq., Senior Associate, Zetlin and De Chiara LLP

  • Scott A. Churilla, Vice President, CDM Smith
