P3, EPC & Design-Build
Zetlin & De Chiara has extensive experience with new and alternative methods for completing complex projects. We have developed contracts and resolved disputes involving P3, EPC and Design-Build projects in both the private and public sectors.
The following are select representative matters:
We represented a design-build developer in a high-profile intellectual property dispute surrounding the improper use of our client's design without its permission or consent.
We negotiated design-build documents for a $110 million Alternate Care Facility project. The agreements were negotiated quickly with the U.S. Government to allow for the emergency construction of the facility for treatment of patients affected by COVID-19.
We represented the owner of the landmarked Empire State Building, one of New York City's iconic skyscrapers, in negotiating and drafting agreements for the highly unusual design-build delivery system for a new auxiliary FM antenna on a transmission tower atop the Empire State Building, with associated equipment and a temporary cocoon installation to ensure safety and to avoid interruption of building operations.
We negotiated design-build development contracts for food services distribution and packaging facility.
We represented a number of hospital related entities in the construction of new and renovation projects.
We developed and negotiated a series of design-build construction contracts on behalf of one of the New York area's largest hospital systems.
We represented EPC contractor in claims against an owner for additional compensation due to delays.
We were retained to represent our client in a hotly contested litigation over a state-of-the-art industrial production facility.
We represented the United Nations Procurement Service in the review and preparation of form RFPs, construction management agreements, preparation of general conditions and associated risk management analysis in connection with classified security-related design-build projects abroad.
